For Michael Wiper, the founder of craft brewing company Wiper and True in Bristol, UK, Boris Johnson’s initial lockdown speech on 23rd March sounded like a death knell.

At least consumers have not suddenly gone teetotal – in fact, 21% of people in the UK have admitted to drinking more during lockdown. Sales of alcohol in British supermarkets and off-licenses were up 27% in April, according to consumer analysts Kantar, while the US has seen a 75% rise in tequila sales and ironically, perhaps, 50% growth in sales of Corona beer. Section 4: Liquor Delivery and beer delivery near me Services
4.0 Introduction

The Liquor Control and Licensing Act and Regulation permits a delivery service to purchase liquor on behalf of a customer
and deliver the liquor to the customer.

This policy explains what types of businesses are allowed to offer liquor delivery
service and the rules related to delivery.

This policy does not apply to liquor delivery by a licensee retail store, wine store or manufacturer on-site store.

Specific
delivery policies for these stores are found in the Terms and Conditions Handbooks for licensee retail stores, wine stores
and manufacturers.

4.1 Liquor Delivery Services

Policy Rationale
Liquor delivery services are allowed by the Act but are not licensed.

This policy explains what types of businesses are
included in the concept of liquor delivery services and the rules related to lawful delivery including record keeping
requirements and preventing delivery to minors or intoxicated persons.

4.1.1 Types of business allowed to operate a liquor delivery service
A delivery service is defined in the Regulation as a business primarily engaged in the transportation of people or goods.

The business may include liquor as one of the items it will transport. In addition, flower shops and gift-basket or hamper
businesses may offer their customers the option to add liquor to their products for delivery in accordance with this policy.

No special license or authorization is required from the Liquor and Cannabis Regulation Branch to operate a delivery
service; 

however, there are regulations and policies controlling the delivery of liquor that must be followed.

In addition,
delivery services should ensure they meet all local or First Nation government requirements that may be in effect where
the business operates.

4.1.2 Delivery Service Requirements
The Liquor Control and Licensing Act and Regulation impose the following requirements on delivery services:

• Orders must be placed by a customer before the liquor is purchased by the delivery service; a delivery service must
not keep a stock of liquor in anticipation of forthcoming orders.

• All liquor purchased by a delivery service must be purchased from any of the following licensed retailers:

o BC Liquor Stores (government liquor stores);

o Licensee retail stores (private liquor stores);

o Wine stores;

o Special wine stores;

o Liquor primary establishments (such as a bar) with an off-premises sales endorsement;

and

o Liquor manufacturers with an onsite store endorsement.

• Deliveries must be made by and to people legally able to consume liquor (i.e. not under the age of 19 or
intoxicated), and only at a place where liquor may be legally possessed or consumed.

• Only customers 19 years of age or older may place an order for liquor. When proof of age is required, customers
must show two pieces of identification at the time of delivery.

One of those pieces must be a government issued
identification card such as a driver’s licence with photo, name and birth date.

The other piece must contain the
person’s name along with a signature and/or photo.

A liquor delivery service may only advertise that it will deliver
beer, wine and spirits (or use the word ‘liquor’).

It must not advertise any liquor manufacturers or their brands or
prices of the liquor.

• The charge for the liquor must be the price paid by the delivery service for the liquor, plus a separate delivery
charge.

Customers must be informed of both charges when they place an order and it must be itemized on the
invoice given to the customer.

• Deliveries must occur between 9 a.m. and 11:30 p.m. on the same day the order was placed.
• Delivery transaction records must be kept for at least one year.

These must include the name and address of the
purchaser, the purchase date, the time and date of delivery and the price of the liquor and the delivery service
charge.

4.1.3 Authorization for food primary and liquor primary establishments that deliver
liquor with a meal

Food primary and liquor primary licensees are authorized to sell and deliver packaged (that is, unopened) liquor of all types
for off-site consumption with the order of a meal.

Until June 6, 2021, and subject to terms and conditions, draught beer can also be sold and delivered for off-site
consumption in new glass vessels referred to as growlers and bombers provided by the licensee in conjunction with the
sale of a meal.

Third-party delivery services may also deliver liquor with a meal sold by liquor primary and food primary licensees.

The
requirements for third-party liquor delivery services are established in the Liquor Control and Licensing Regulation.

Packaged liquor delivered on behalf of a food primary and liquor primary licensees can only be delivered by an individual
with Serving It Right (SIR) certification.

 This means the delivery person of a third-party delivery service must have SIR
certification.

4.1.4 Third Party Advertising Requirements
The Liquor Control and Licensing Act and Regulation only allow a third party, such as a delivery service, to advertise where
the liquor is available and, whether the liquor is beer, wine or spirits, without referring to the names of manufacturers,
liquor products or the price of liquor.

Online delivery platforms may only serve as a “portal” with links that direct customers to either:

• Websites independently owned and operated by licensees where the sales are processed;

or
• Space on the online delivery platform that is equivalent to a licensee’s own website.

Space on an online delivery platform is considered to be equivalent to a licensee’s own website when the following
conditions are met:

• The licensee’s store name, licence number and store address are displayed prominently on the page;

• The licensee has exclusive control over the product selection and the price being advertised;

• The product selection is reflective of the licensee’s in-store offerings;

and
• Liquor orders made on the website are processed and prepared by the licensee.

5.0 Introduction
It is not lawful to sell liquor, or to provide liquor in consideration of some other purchase, without a license.

Through the
Liquor Control and Licensing Act and its regulations, and by requiring anyone who holds a liquor licence to meet strict terms
and conditions of that licence, the government works to protect public safety.

5.1 Unlicensed internet sales
Policy Rationale

To be eligible for any kind of license or appointment for the retail sale of liquor, a person must have a store front operation
with a legal interest in the proposed physical site of the business.

When there is no physical establishment from which the
business would operate (where it is a “virtual” business), the business cannot be licensed.
At this time, no new licensee retail store or wine store licences are being issued.

5.1.1 Unlicensed internet liquor sales prohibited
Licensed establishments may use the internet as part of their advertising and sales strategy.

However, unlicensed internet

 How we drink causes a lot of alcohol-related problems and results in over $14 billion in costs each year. 

Much of this is preventable.

The scientific evidence tells us that there are daily and weekly levels of
drinking that will help prevent some of the harms and reduce the health,
legal and labour costs. The new guidelines help drinkers to balance
potential benefits with a consideration of the potential harms. They
identify drinking patterns which will help prevent harms or which raise
the risk of problems.

The guidelines are not intended to encourage people to drink. They
inform drinkers that drinking above the suggested limits will put them
at risk for injuries or chronic diseases. They also provide advice on
when not to drink (e.g. when pregnant or planning to be pregnant, when
driving a vehicle or doing any kind of dangerous physical activity), and
they provide tips for reducing risk (e.g. drink slowly, eat before and
while you are drinking, do not start drinking for health benefits).

While the guidelines will not change the drinking culture overnight, they
may help us reduce the rising costs related to alcohol in our cities and
provinces by encouraging Canadians to adopt a culture of moderation

Yes, all delivery persons that deliver liquor must have a valid Serving It Right certificate.

Yes. Flower shops, gift basket and hamper businesses may offer their customers the option to add liquor to their products for delivery only.

Can I sell liquor online or start an online beer or wine subscription box?

  • Only liquor licensees with a retail storefront operation are permitted to sell their products online. These licences include licensee retail store, wine store, and manufacturer with an onsite store.
  • Unlicensed business are permitted to deliver liquor. The policies regarding liquor delivery and third-party advertising requirements are outlined on pages 14-15 of the Miscellaneous Liquor Policy. (link out to the specific section)

Does a business such as a B&B, hair salon, or art studio need a liquor licence to sell, gift, or serve wine to their customers?

Yes, businesses require a liquor licence or Special Event Permit to sell, gift, or serve wine (or any type of liquor) to their customers.

Yes, licensees have the right to refuse service if they believe that a patron is a minor or attempting to purchase liquor for a minor.

Licensees may set their own policies to ensure no minors are served or given liquor, or sign up for a beer delivery after hours membership.

  • For example, they can refuse to serve or sell liquor to a group if a person in the group can’t show valid identification.

A customer cannot insist on being served liquor if a licensee has refused service.

Responsible liquor consumption

In B.C., liquor is defined as beer, wine, or spirits, or any other product intended for human consumption, that contains more than 1% alcohol by volume.

Some products such as cooking wine and liquor-filled chocolates can be classified as non-beverage alcohol and may not be considered liquor. See apply for non-beverage alcohol exemption for more information.

The legal drinking age is 19. Anyone under 19 is a minor and can not get a membership for our beer delivery after hours.

It is generally against the law to provide alcohol to a minor.  There are a few exceptions when alcohol is given to a minor including:

  • By a parent, guardian, or spouse in a residence for consumption in the residence,
  • By a doctor or dentist for medical purposes, or
  • As sacramental wine in a religious ceremony
 

What identification (ID) do I need to buy liquor?

If you are asked to provide ID, you will need to show

  • An official government issued primary ID (including foreign government issued) with name, picture and birth date;

  • A secondary ID that includes name and signature or picture; such as a credit card or student ID

An expired ID may be used as long as it proves your age. If a server has any doubt about an ID, they may refuse service.

Primary ID

  • State or provincial driver’s licence

    • The B.C. Driver’s Licence and Services Card, which combines the B.C. Driver’s Licence and Services cards

  • The Photo BC Services Card

    • Formerly CareCard, counts as only one piece of ID

  • Citizenship card

  • First Nations status card

  • The federal Firearms Possession and Acquisition licence

Secondary ID is used to verify the authenticity of the first piece, and must include

  • The holder’s name

  • Either the holder’s signature OR picture

Any acceptable piece of primary ID can be used as secondary ID for your beer delivery after hours membership. Examples of other acceptable secondary ID include:

  • BC CareCard (which will be replaced by 2018 with the Non-Photo BC Services Card)

  • Interim driver’s licence (issued by ICBC)

  • BC Transit ProPASS

  • University or college student card

  • Credit card

  • Canadian Blood Services donor card

  • Transport Canada’s Pleasure Craft Operator’s Card

  • Many bank cards and rewards cards

  • National Defence ID

You can’t bring your own liquor into a licensed establishment (a pub,  night club, stadium, etc.)  

There are exceptions such as restaurants that offer a “bring your own wine” option. Not all restaurants permit this, so be sure to check in advance, and ask about the corkage fee.

Yes, provided one of the servers re-seals it before you leave. If you are leaving by car, you must ensure it is not readily accessible to anyone in the vehicle while driving.

  • For example, store it behind the seat or in the trunk

You can’t drink liquor in a public place unless the area is licensed, or a municipality or regional district designates it as a place where liquor can be consumed.

You can drink liquor in a residence or private place, such as outdoors on your property or at a campsite.

You can bring liquor into B.C. from other Canadian provinces for personal consumption without any restrictions or limits. 

Contact the Liquor Distribution Branch about bringing liquor from out-of-country, including personal liquor collections and wine cellars.

Liquor and motor vehicles

Liquor in a container that has been opened or has a broken factory seal must not be readily accessible to anyone in a motor vehicle.

Possession of open liquor in any private or commercial motor vehicle (such as a party bus or a limo) is illegal whether the motor vehicle is moving or not.

For recreational vehicles such as motor homes, campers, and trailers, consumption of liquor is only permitted where camping is allowed. At no time may the driver or passengers consume liquor while the vehicle is mobile.

The same rules which prohibit driving while impaired also apply to boats: you must not operate, assist to operate, or have the care and control of a vessel while impaired by alcohol or with a blood alcohol level more than .08.

Liquor must only be consumed in boats or other watercraft if the boat is licensed or it is a boat that the public does not have access to and is equipped with sleeping accommodations, cooking facilities and a toilet. In these cases, liquor may be consumed in the cabin or on the deck of the boat.

People using smaller boats for a special event (such as a day charter by a social club for its members) must obtain a Special Event Permit if they wish to sell or serve liquor to participants.

Cruise ships and larger motor vessels that travel scheduled routes or from one destination to another may be licensed if they provide a service that, while primarily marine oriented, is consistent with the services provided by other sectors of the hospitality industry (for example, luncheon and dinner cruises).

Liquor store bottle and can returns

Yes. You can return empty bottles or cans to a liquor store where that product is sold and you will receive a deposit refund.

The store may set a limit of 24 containers per person per day. The retailer does not have to accept a can or bottle if it is rusty, unidentifiable, or otherwise questionable.

Liquor stores do not have the same capacity for returns as a recycling centre or bottle depot.
